OpenAI has filed a countersuit against Elon Musk, claiming that the billionaire engaged in harassment. The company is asking a federal judge in the United States to prevent Musk from conducting any further "unlawful and unfair actions" against it.

Background of the Dispute

OpenAI was co-founded by Musk alongside Sam Altman in 2015. Since its inception, the two have frequently disagreed over the direction of the organization, particularly as it shifted from a complex non-profit model to a more conventional for-profit structure.

Musk’s initial lawsuit against OpenAI originated from concerns about its restructuring plans, which he believed deviated from its foundational mission of benefiting humanity. Although he withdrew the lawsuit in June, he quickly filed a new one in August, showing ongoing conflict.

Recent Developments

Earlier this year, Musk made headlines when he led a group of investors in a surprising bid to purchase OpenAI for $97.4 billion. Sam Altman promptly rejected this offer and made a light-hearted remark on X (formerly Twitter), stating that they could buy Twitter for $9.74 billion if Musk was interested. Just to note, Musk bought Twitter, which has since been renamed X, for a substantial $44 billion in 2022.

In legal documents submitted to a California court, OpenAI accused Musk of employing various tactics to harm the company. They cited actions such as press attacks, campaigns aimed at OpenAI’s reputation, demanding corporate records, and filing legal claims. The suit claims these actions constitute harassment and seeks to hold Musk accountable for any damages caused.

A jury trial to address these issues is anticipated to commence in the spring of 2026.

The Split Between OpenAI and Musk

Musk departed from OpenAI in 2018 and went on to establish his own company, xAI. In this recent bid for OpenAI, Musk’s xAI firm was supported by several investment companies, including one led by Joe Lonsdale, co-founder of the technology firm Palantir.

Musk has publicly criticized OpenAI for straying from its altruistic mission, particularly after it created a for-profit subsidiary to attract investments, notably from tech giant Microsoft. Originally, OpenAI was founded as a non-profit entity aiming to develop advanced AI technologies that would serve humanity. The organization argues that adopting a for-profit model is essential to advance AI development effectively.

Financial Milestones

In a recent funding round, OpenAI secured $40 billion from SoftBank and other investors, which valued the company at an impressive $300 billion. The funds are intended to further propel AI research and enhance infrastructure, aiming to deliver powerful tools to the 500 million weekly users of ChatGPT.

OpenAI has experienced several significant shifts following the rise of ChatGPT, which gained immense popularity in 2022. Earlier in 2023, the OpenAI board dismissed Sam Altman allegedly for a lack of transparency in his communication. However, he was reinstated within a week after numerous employees threatened to resign if he was not brought back.
